Federal Judge Orders Release of Abrego Garcia from Immigration Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.

In her decision, the judge pointed out that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Background of the Case

The legal proceedings center on disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.

He has also pleaded not guilty to the smuggling counts, which are part of a separate criminal case in Tennessee.

The judge, who was hearing his challenge to removal in a federal court, determined that he must now adhere to the terms of his release from custody in Tennessee. This order shifts his supervision to the Tennessee court.
